SCICAN Corporation agrees to provide and Member agrees to receive access to the SCICAN Corporation Internet service according to the following terms and conditions:
The purpose of the SCICAN Corporation is to assist in the exchange of information for the purposes of education, research, and business development. Therefore, the use of your network account must be used as a resource to gather and disseminate information that will be used in a positive manner to benefit children, family, education, business, the community or yourself. The smooth operation of the SCICAN network relies upon the proper conduct of the members who must adhere to strict guidelines. SCICAN is providing a list of these guidelines so that you are aware of the responsibilities you are about to acquire. We require each member of SCICAN to demonstrate efficient, ethical, and legal utilization of the network resources. The signature(s) at the end of this document is (are) legally binding and indicates the party (parties) who signed has (have) read the terms and conditions carefully and understand(s) their significance.
Individuals throughout the community may obtain a SCICAN account by completing and signing this SCICAN Corporation Service Agreement and Acceptable Use Policy. Accounts for new members will be set up on the network once the application is approved and the appropriate fees are paid. Individuals gaining approval for an account must use their real name and select a personal password. Aliases or slang names will be prohibited. Any individual identified as a security risk to our system or having a history of problems with other computer systems may be denied membership in SCICAN.
1. Membership in SCICAN is a privilege, not a right, and inappropriate use will result in a cancellation of those privileges. The system administrators will deem what is inappropriate use. After consultation with the SCICAN Board of Directors, system administrators may close an account at any time as required. Individuals having SCICAN accounts must abide by the rules and regulations stated in this policy in order to receive the privilege of accessing the network.
2. All of the provisions of SCICAN Corporation's service agreement (hereinafter referred to as "Agreement") shall apply to the Member's Principal Account and Associate Accounts billed to the Principal Account. (Account holder named below herein referred to as "Member.")
3. This Agreement shall be governed by the laws of the State of Indiana.
4. The rights of access conveyed by this Agreement are non-transferable. Use of a SCICAN Corporation account is expressly limited to the individual or dependents whose names appear on the application for personal accounts or to employees whose names appear on the application for business accounts.
5. Non-enforcement of any section of this Agreement does not constitute consent.
6. If any one or more paragraphs in this Agreement is found to be unenforceable or invalid, Member's and SCICAN Corporation's Agreement on all other paragraphs shall remain valid.
1. DO NOT reveal your personal information such as address, phone numbers, credit card numbers, etc.
2. DO NOT reveal the personal addresses or phone numbers of students, friends, colleagues, etc.
3. Remember your password. SCICAN does not accept responsibility for Members who forget their password.
4. If you feel you can identify a security problem on SCICAN, notify a system administrator. Do not demonstrate the problem to other users.
5. Do not use another individual's account without written permission from that individual.
6. It is recommended that Members of SCICAN use at least a 9600 baud modem to achieve full Internet functionality.
1. The Member agrees to use this service in a manner consistent with any and all applicable laws, whether state, federal or by international treaty.
2. Use of any distribution lists in electronic mail or other mass electronic mailings is subject to approval by SCICAN Corporation.
3. Transmission of any material in violation of any U.S. or state regulation is prohibited. This includes, but is not limited to: copyrighted material, threatening or obscene material, or material protected by trade secret.
4. Connection into another organization's network or computing resources must comply with the rules appropriate for that network as well as the rules for SCICAN Corporation. The generally accepted rules of network etiquette ("netiquette") include (but are not limited to) the following:
1. The Member is responsible for all use of Member's account(s) and confidentiality of password(s). SCICAN Corporation will suspend access or change access to Member's account(s) within twenty four (24) hours or less after notification by Member that his/her password has been lost, stolen or otherwise compromised.
2. The member is responsible for any and all local or long-distance telephone charges for connecting to the network.
3. The Member agrees to pay SCICAN Corporation for any and all charges relating to the use of Member's account(s) according to rates and prices published on-line at the time the service is used. However, on-line rates and prices are incorporated into this Agreement by reference. Member is also responsible for any monthly storage charges as described on-line.
4. The Member is responsible for charges at the time the service is used and SCICAN Corporation may apply the amount due to Member's credit card at any time. The charges typically will be monthly, unless the Member's credit limit is reached.
5. The Member agrees to give thirty (30) days written notice to Net Direct in
order to cancel account. All outstanding balances will still be due.
SCICAN Corporation reserves the right to:
1. THE SCICAN CORPORATION SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE MADE WITH RESPECT TO SCICAN CORPORATION OR ANY INFORMATION OR SOFTWARE THEREIN. THIS "NO WARRANTY" EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY SCICAN CORPORATION OR ITS PROVIDERS.
2. SCICAN makes no warranties of any kind, whether expressed or implied, for the service it is providing. SCICAN will not be responsible for any damages you suffer. This includes loss of data resulting from delays, non deliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via SCICAN Corporation's services is at your own risk.
3. Neither SCICAN Corporation nor its Information Providers are responsible for any damages arising from Member's use of SCICAN Corporation's services or by Member's inability to use SCICAN Corporation service.
4. SCICAN Corporation is not responsible for Member's personal files residing on SCICAN Corporation equipment. Member is responsible for independent backup of data stored on SCICAN Corporation equipment.
5. THE MEMBER HEREBY AGREES THAT ANY MATERIAL SUBMITTED FOR PUBLICATION OR STORAGE ON SCICAN CORPORATION'S EQUIPMENT THROUGH MEMBER'S ACCOUNT(S) DOES NOT VIOLATE OR INFRINGE ANY COPYRIGHT, TRADEMARK, PATENT, STATUTORY, COMMON LAW OR PROPRIETARY RIGHTS OF OTHERS, OR CONTAIN ANYTHING OBSCENE OR LIBELOUS.
6. Due to the public nature of the Internet, all electronic mail is considered publicly accessible and important information should be treated carefully. SCICAN Corporation is not liable for protection or privacy of electronic mail and information transferred through the Internet.
7. SCICAN Corporation does not accept responsibility for a member's participation in activities involving money.
8. SCICAN Corporation specifically denies any responsibility for the accuracy or quality of information obtained through its services.
9. Member understands that SCICAN Corporation acts as a gateway in providing access to the Internet and is not responsible for content.
The above mentioned policies are subject to revision as determined by the SCICAN Corporation Board of Directors.
